SCRA Protections in Divorce Proceedings
The Servicemembers Civil Relief Act (SCRA) protects active-duty service members from being placed at a legal disadvantage when military duties prevent them from attending court. A service member can request a stay of proceedings for at least 90 days when deployment or duty obligations make an appearance impossible.
That request isn’t automatic. It requires a written statement explaining how military duties affect the ability to appear, along with a letter from the commanding officer confirming that duty prevents attendance and that leave isn’t currently authorized. Without those formal steps, a court can proceed and may enter a default judgment against the absent service member. The 10/10 Rule: What It Actually Means
Few issues generate more confusion in military divorce than the 10/10 Rule, and the most common misunderstanding carries real financial consequences. Many people believe that if the marriage didn’t overlap with at least 10 years of military service, the former spouse can’t receive any share of the military pension. That’s incorrect.
The 10/10 Rule under the Uniformed Services Former Spouses’ Protection Act governs how pension payments are made, not whether the pension is divisible. When the marriage overlapped with 10 or more years of qualifying service, the Defense Finance and Accounting Service (DFAS) can send payments directly to the former spouse. When that threshold isn’t met, Florida courts can still award a portion of the pension. The service member makes those payments directly rather than through DFAS. We apply this distinction in property division negotiations and, when necessary, in Okaloosa County family court.
